This privacy notice for Balanse, Inc. (“we,” “us,” or “our”) describes how and why we collect, store, use, and/or share (“process”) your information when you use our services (“Services”), such as when you:

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

Sensitive Information. We may process limited sensitive personal information in connection with the Services, such as date of birth (to calculate age), health- and safety-related information you choose to provide, and motion sensor data collected during training sessions. We do not intentionally collect sensitive identifiers like Social Security numbers, driver's license numbers, or precise geolocation.

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number and the security code associated with your payment instrument. All payment data is handled by Apple or Google as provided by their respective app stores. We do not store or process any payment details on our own servers.

Social Login Data. We may provide you with the option to register or log in using a third-party account (for example, Apple or Google). If you choose to register or log in this way, we will collect certain profile information about you from the provider, as described below in “HOW DO WE HANDLE YOUR SOCIAL LOGINS?.”

Application Data. If you use our application(s), we may also collect device and usage information, such as your mobile device ID, model, manufacturer, operating system, and version information. We may collect certain permissions (e.g., notifications) that you grant. This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

Exercise and Sensor Data. When you use the mobile app to perform training sessions (“events”), we collect and store information about those sessions (such as the exercise performed, duration, settings, scores, and safety-related signals like fall or “jerk” detection). We may also collect motion sensor readings from your device (for example, accelerometer and gyroscope signals) and derived orientation metrics (for example, pitch/roll). We store these sensor readings in a compressed format. We use this information to provide the Services (including real-time feedback and safety features), troubleshoot issues, and improve our algorithms.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes.

Information automatically collected

In Short: Some information — such as your IP address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may share your data with vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information. We have contracts in place to help safeguard your personal information. We may also share your information in connection with business transfers (like a merger or acquisition), with affiliates, with business partners, or as otherwise noted in this policy.

De-identified and Aggregated Data. We may create de-identified and/or aggregated information from your use of the Services, including from event and sensor data (including de-identified sensor datasets and aggregated statistics), and we may share or sell that information with third parties for research, analytics, or commercial purposes (for example, researchers, insurers, or other organizations interested in balance and fall-risk trends). This information is designed not to identify you and does not include direct identifiers such as your name, email address, or full date of birth (it may include age or age ranges instead). We take steps to reduce the risk that you could be re-identified and require recipients to agree not to attempt to re-identify you. Where required by law, we will provide additional notice and obtain your consent before sharing such data.


5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some are necessary for security and basic functionality; others are used by third parties to tailor advertising or provide analytics. Google Analytics. We may share your information with Google Analytics to track and analyze the use of the Services. To opt out of Google Analytics, visit Google's opt-out page.


6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a third-party account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party account details (e.g., Apple or Google). Where you choose to do this, we will receive certain information about you from the provider, such as your name, email address, a provider-specific user identifier, and (if available) a profile picture. We will use that information as described in this notice, but we do not control and are not responsible for the provider’s data practices, which you should review in their own privacy policies.


7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or securely store it until deletion is possible.


8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate security measures designed to protect the security of any personal information we process. However, no electronic transmission over the Internet or information storage technology can be guaranteed 100% secure, so we cannot promise that unauthorized parties will not be able to defeat our safeguards. You should only access the Services within a secure environment.


9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 13 years of age.

We do not knowingly collect, solicit data from, or market to children under 13 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 13 or that you are the parent or guardian of a minor under 13 who uses our Services with your consent. If we learn that personal information from users less than 13 years of age has been collected, we will deactivate the account and promptly delete such data from our records. 10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions (like the EU, UK, Switzerland, Canada, and certain US states), you have rights that allow you greater access to and control over your personal information.

These may include the right to request access and obtain a copy of your personal information, to request rectification or erasure, to restrict or object to the processing of your personal information, and (where applicable) to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information.

If you are located in the EEA, UK, Switzerland, or Canada and believe we are unlawfully processing your personal information, you have the right to complain to your local data protection supervisory authority. If you are in Switzerland, you may contact the Federal Data Protection and Information Commissioner .

If you are in the United States, certain states grant additional privacy rights that may allow you to access, correct, or delete your personal data, or opt out of certain data processing practices. For details, please see the section titled “DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?” below.

Withdrawing your consent. If we are relying on your consent to process your personal information, you can withdraw your consent at any time by contacting us at contact@balanse.app. This will not affect the lawfulness of processing before its withdrawal, nor will it affect processing conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications. You can unsubscribe from our marketing and promotional communications at any time by clicking the unsubscribe link in our emails, or by contacting us at contact@balanse.app. You will then be removed from the marketing lists, though we may still communicate with you for non-marketing reasons (e.g., to send service-related messages).

Account Information

If you would like to review or change the information in your account or terminate your account, you can:

Upon your request to terminate your account, we will delete your data from our active databases. However, you can also delete your profile (and all associated data) at any time directly within the app settings, which will remove the data without delay. 11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature. Because there is not an industry or legal standard for recognizing or honoring DNT signals, we do not currently respond to DNT browser signals. If a standard for online tracking is adopted in the future, we will inform you about that practice in an updated version of this privacy notice.


12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes. If you are a resident of certain US states, you may have the right to request access to, correct, or delete your personal information, opt out of certain data practices, and exercise other privacy rights, subject to limitations in law.

Depending on your state of residence (e.g., California, Colorado, Virginia, etc.), these rights may include the right to know whether we process your personal data, the right to access your data, the right to request deletion of your data, the right to correct inaccuracies, and the right to opt out of the sale or sharing of personal data for targeted advertising or other purposes. 13. DO OTHER REGIONS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes. Laws in countries such as Australia and New Zealand (among others) may grant additional data protection rights. This privacy notice is intended to meet those requirements to the extent applicable.

For instance, under the Privacy Act 1988 (Australia) and the Privacy Act 2020 (New Zealand), you may request access to or correction of your personal data. If you believe we are not complying with the requirements of your applicable privacy laws, you can lodge a complaint with your local data protection authority.


14. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this privacy notice from time to time. The updated version will be indicated by an updated “Revised” date, and the updated version will be effective as soon as it is accessible.
